Daily Workout--June 12, 2011
Today I did the Duff Triple again.
Running
3 miles
38 minutes, 51 seconds
While this is a little slower than Friday, this 'run' involved the least amount of walking. So far, I've been alternating between running/jogging and walking. I usually do street sign intervals....from one street sign to the next, I'd run. Then I'd walk to the next street sign, then run, then walk, etc. On good days, I'd do run two intervals then walk one. Today however, I walked for less than 1 minute of the entire trip. So it's a little slower than before becuase I was varying my running/jogging, but I severly limited my walking. So it's progress & I'll take it.
Gym [reps x weight]
Bench Press: 15 x 135, 10 x 165, 10 x 185, 5 x 225
Incline Press (each arm): 10 x 70, 10 x 80, 9 x 90
Butterfly: 10 x 80, 10 x 90, 10 x 100
Overhead Tricep Extension: 10 x 80, 10 x 90, 10 x 95
Tricep Pushdown: 10 x 60, 10 x 65, 10 x 70

Air Show
No workout today. I woke up earlier & drove into Lancaster to my sister's house. I picked up my nephew and oldest niece and took them to southern ChesCo for an air show. Didn't know southern ChesCo had an airfield? I didn't either til the middle of last week. But there is an airshow there, in the middle of New Garden Township, just off Route 1.
We got there before the planes started taking off, so I got suckered into spending money. My nephew wanted to do the rock climb and my niece wanted to do some trampoline contraption.
After the rides, they decided to get their faces painted (though my nephew wanted it on his hands instead)
After I dropped them back off at their house, my youngest three nieces demanded I take their picture. I'm not sure exactly (and was afraid to ask my sister) why two of the three had shaved heads.
Overall, a pretty fun day. The rain held off and other than spending money I don't particularly have to spend & getting a little bit of sunburn, it was a successful day.

Then the air show started. It was pretty cool to see all the old planes flying as well as the stunt planes doing tricks. I haven't been to an air show since I was a little kid, but I enjoyed it tremendously. One of my favorite parts was the fly-by of the B2-Stealth Bomber. If I had a favorite airplane, this would be it.

Waiting Room
I watched the season finale of the NBC show "Parenthood" tonight. Holy crap. What an episode that was.
The show started out with various family members finding out that a young girl was in a car accident and was in the hospital. In true TV show fashion, every extended family member showed up at the emergency room waiting room. And it got me thinking. If I were in a car accident and it was unknown if I would make it, who would show up in the waiting room for me? It really saddens me to struggle to answer this. I just don't know who would stop what they are doing and show up.
I know there are a handful of people, that if told they were in that situation, I would drop everything and rush to the hospital. But if it were me, would they show up? I don't know that any of them would show up.

St. Patty's Day pass out
Yesterday was St. Patrick's Day. Across the world, people were passing out. Generally this will be because they overindulged in alcohol.
Me? I didn't need the alcohol to pass out. I apparently can do it on my own.
I was in court yesterday around 4:45pm when it happened. I remember sitting at counsel table during Treatment Court reviews. I was feeling really tired, but wasn't too bad overall. I then started feeling warm, sort of flushed. So I filled a glass with water and began drinking it.
I remember then being called up to a sidebar discussion. I got up, out of my chair and began walking to the side of the Judge's bench. I remember getting to the bench and standing there. The next thing I remember, one of the probation officers is helping me get up. I'm confused, wondering why everyone is looking at me with horrified looks on their faces. The probation officer and one of the deputy sheriffs helped me into a chair on the side of the courtroom.
The deputy sheriff is asking me questions and taking my pulse. I can feel my heart racing as he's taking my pulse, so I'm not surprised when it's fast/high. I then back to the holding cells right off the courtroom and sit down. Another one of the sheriffs comes up with a medical bag and begins examining me. He takes my blood pressure, both sitting and standing. And there is a noticeable difference. When I stand up, my legs are still feeling a bit shaky, but nothing horrible.
I go back into the courtroom and right out into the hall where I go back to my office with some co-workers. One of my coworkers gets me some orange juice and the cheese/peanut butter crackers. By this point, I'm feeling fine, but out of precaution, I get a coworker to give me a ride home.
One of the probation supervisors was standing next to me at the sidebar conference and she filled in some details. She had her back to me, and said I kept tapping her. She turned to yell/ask me what I wanted, and as she turned, I started going down. I somehow grabbed a hold of her pants on the way down (though I thankfully didn't pull her pants down...that wouldn't been really awkward). As I was going down, the other probation officer jumped up from somewhere and caught me on the way down.
Today, I took off work and went to the doctors. Overall he said I'm doing really great and seem to be getting in to shape (I'm prolly in the best shape I've been in since high school). He indicated that the reason I passed out was a combination of reasons. First, I hadn't eaten anything yesterday prior to passing out. Not a good thing. Second, he wanted to adjust one of the medications I'm taking because it's affecting my blood pressure. Specifically, it's causing my blood pressure to drop when I stand up. And it's having that affect because I'm getting into shape. The medicine was too strong because I was getting healthier and my body was doing what it was supposed to do without the medicine. Which is a good thing.
So overall, it was a fluke and I'm doing well. But it certainly was an interesting event.

Let the job hunt begin!
So I'm starting the unfortunate task of looking for a second job. There's really no other way around it. Yes, I don't need to look today, but I know some of my bills will be increasing (hello student loans!!!), and I'm not going to be able to pay them without a second job.
Though it's somewhat a catch 22...my student loan payments are based on my income, so they will be increasing once I file my taxes which reflects my full time job I got last year. So I have to get another job to help pay the bills. Which will just cause the payment amounts to go up. Maybe I'll have to get a third job to cover the increased payments. Which will just increase the payment amount again...vicious cycle if you ask me. And there's no legal way to avoid it.

Spoiled with Chewing Gum
One of the small gifts he gives himself is trying all the gums. "I can spoil myself a little so long as I stay within my means," he says.
This is portion of an article describing a man who served 28 years and 8 months for a rape of an 11 year old girl that he did not commit. He spoils himself by trying the various flavors and brands of chewing gum, a luxury he hasn't had in almost three decades.
You think these things don't happen, but I'm sure they do. Hopefully they don't occur nearly as much as they used it, when the practice of law was really the 'old boys club.'
As a prosecutor, this type of thing is always in the back of my mind. There are many cases that are open and shut and don't cause concern, but there are some that you get involved with and it's in the back of your mind. I'm sure others in the my office would disagree, but if they don't have that in the back of their mind, I think they are failing at their jobs.
After all, who knows when the case will come up where that fear isn't in the back of their minds, but front and center. The pieces don't add up. Something doesn't seem right. The defendant's story seems to be truthful. Will they go ahead anyway and blindly prosecute? If the answer is yes....we've failed.

24 years
fuck you for leaving
fuck you for dying
fuck you for dying
I've always wanted you but you were never there
they say it's not your fault
I say it's not your fault
but it doesn't make it go away
they say it's not your fault
I say it's not your fault
but it doesn't make it go away
time doesn't heal, no matter what the cliche says...

"Keep your fork"
Found this making it's rounds on the internet, so thought I'd share:
There was a young woman who had been diagnosed with a terminal illness and had been given three months to live. So as she was getting her things "in order," she contacted her Pastor and had him come to her house to discuss certain aspects of her final wishes.
She told him which songs she wanted sung at the service, what scriptures she would like read, and what outfit she wanted to be buried in.
Everything was in order and the Pastor was preparing to leave when the young woman suddenly remembered something very important to her.
"There's one more thing," she said excitedly.
"What's that?" came the Pastor's reply
"This is very important," the young woman continued. "I want to be buried with a fork in my right hand."
The Pastor stood looking at the young woman, not knowing quite what to say.
"That surprises you, doesn't it?" the young woman asked
"Well, to be honest, I'm puzzled by the request," said the Pastor.
The young woman explained. "My grandmother once told me this story, and from that time on I have always tried to pass along its message to those I love and those who are in need of encouragement. In all my years of attending socials and dinners, I always remember that when the dishes of the main course were being cleared, someone
would inevitably lean over and say, 'Keep your fork.' It was my favorite part because I knew that something better was coming.....like velvety chocolate cake or deep-dish apple pie. Something wonderful, and with substance!'
So, I just want people to see me there in that casket with a fork in my hand and I want them to wonder "What's with the fork?" Then I want you to tell them: "Keep your fork, the best is yet to come."
The Pastor's eyes welled up with tears of joy as he hugged the young woman good-bye. He knew this would be one of the last times he would see her before her death. But he also knew that the young woman had a better grasp of heaven than he did. She had a better grasp of what heaven would be like than many people twice her age, with twice as much experience and knowledge.. She KNEW that something better was coming.
At the funeral people were walking by the young woman's casket and they saw the cloak she was wearing and the fork placed in her right hand. Over and over, the Pastor heard the question, "What's with the fork?" And over and over he smiled.
During his message, the pastor told the people of the conversation he had with the young woman shortly before she died. He also told them about the fork and about what it symbolized to her. He told the people how he could not stop thinking about the fork and told them that they probably would not be able to stop thinking about it either.

Family
I knew my sister was having some trouble, but I recently found out her house was condemned and she is now living in a local shelter. With her five children.
I feel so bad for my nephew (who is the oldest at 8) and my four nieces (ranging in age from 1 year to 6 years). I wish there was something I could do to help them. But I'm flat broke. And my living arrangement doesn't permit me to really have any of them stay over, even for a few days. I don't care about necessarily helping my sister, because she chose her life. But my nieces and nephew didn't. Why should they have to live in a shelter merely because of the poor choices their mother made? Why should they have to suffer?
If I had the money and/or the space, I'd tell my sister to have my nephew live with me. I couldn't offer him a lot, but I could offer him a stable home. But I don't have the resources to do that.
The other thing I've told my sister to look into is the Milton Hershey School. I think, especially now with her housing uncertainty, she should look to what's better for her children.
But it's not my choice and I have no say in the matter. It just kills me to think about what my nephew is having to deal with through no fault of his own. Kind of similar to my life in some respects....I went through a challenging childhood. While I think I turned out (mostly) alright, I fear that he may not be able to.

Because we can...
Some days I really dislike my job. Overall it's a great job, but there are times where I can't stand it.
For a little background, I work with our Treatment Courts: Mental Health Court, Drug Court, and Recovery Court. All three are great programs and after working in my office for about 3 years (both as an intern and full time), I don't believe I would want to work in my office if I wasn't doing the Treatment Courts. The reason is that our office seems to have the mentality of "lets do something because we can, not because we should." However, I have the ability to do what's 'right' working in the Treatment Courts.
And frankly, I'm offended by that philosophy. We have a lot of power as prosecutors: power to charge/not charge, power to decide what (if any) offer to make in a given case, power of a sentence to ask the judge to impose. And merely because a sentence is available doesn't mean we should ask for it. Merely because the elements of a crime could technically be proven, doesn't mean we should charge someone with a crime.
But my office thinks otherwise. They have the mentality that we should do something "because we can, not necessarily because we should."
Case in point. There is a case where a 18 year old man was charged (hereafter the "defendant"). He lives with his mother and they were staying the house of the mother's friends. Police were called after the homeowner noticed a bottle of alcohol was empty and two bottles of her own son's 800mg Ibuprofen pills (a prescription) was empty. None of the three bottles had been empty earlier in the evening. When police arrived, they found the defendant lying on a bed with a 'suicide note' beside him. They noticed that he appeared to be under the influence of something. Based on what they saw, police got an order to involuntarily commit defendant to a psychiatric hospital. While he was being prepared for transport, the homeowner found another empty pill bottle of a muscle relaxer (a controlled substance under PA law). Instead of being taken to the psychiatric hospital, defendant ended up being admitted to intensive care and had to be put on a ventilator (the hospital reported that had defendant been allowed to fall asleep, it is unlikely he would have woken up based on what he took).
So far it sounds fine. Police got an order to involuntary commit defendant to a psychiatric hospital. That's what they should have done...the guy defnitaly needed help. However, the police didn't stop there. They also charged him with underage drinking and two counts of possession of a controlled substance.
Really? A guy tries to commit suicide and is now getting involved with the mental health system to get treatment, and we're going to prosecute him as a criminal? I'm not saying that any suicide attempt should entitle someone to get out of prosecution. But in this case, I see no reason to prosecute the defendant. Absolutely none at all.
So I went to my supervisor in an attempt to get approval to withdraw the charges. He disagreed with me. Told me that we should prosecute this guy and that maybe he'd be eligible for diversion in Mental Health Court (he's not, becuase while he has some sort of mental illness, it doesn't qualify as a serious mental illness). So we're going to prosecute this guy, not becuase we should, but because we can.
Fucking ridiculous. An abuse of our discretion as district attorneys.

Bathroom ettiquete
I walked into the bathroom at work today. As I was walking in, I sneezed. Somebody (presumably a man) was in one of the stalls and said "bless you."
Two questions:
1) Is that proper ettiquete, to say "bless you" from the shitter?
2) Was I rude to not say "thank you?

Cover charge is for the alcohol & medical exam
Here is an interesting article. It's about a woman (or possibly a man or a transgender person...the article is not entirely clear) who was arrested after giving 'breast exams' in a bar and nightclub.
Who the hell lets someone feel them up in a bar under the rouse of it being a 'breast exam?' Are people really that stupid in this world?
Let's see what should have tipped these 'victims' off:
1) the arrested woman gave her name as Berlyn Aussieahshowna. That sounds totally legit to me...
2) you're in a BAR (or nightclub)!!!!! I don't care if the person gave you copies of their medical license, you're really going to let someone perform a medical procedure in a BAR???
What kind of alcohol do they serve in Boise???

2011 Resloutions
I think it's kind of cheesy to make New Year resolutions, but here's some of the things I want to accomplish in 2011 (broken into categories)...
Health
--Get down to 240 pounds
--Exercise 200 days of the year
--Run a 12 minute mile
Financial
--Pay down my credit card debt so that I owe under $4000
--Establish my 'emergency fund' with $2500 in it
Family/Relationships
--Have my nephew down for at least two weekends
--Get comfortable with myself, so that I can have a relationship with someone
I think these are all feasible, but will require some work. And I think that's enough goals for one year. We'll see how it goes.
